TERMS AND CONDITIONS
By accepting the quotation and paying a deposit with Christine Storey (Storey Digital Art), you confirm that you are in agreement with and bound by the terms and conditions below:
Any additional work, revisions or variations outside of the original quotation will be charged at the rate of $45 per hour, billed in 15 minute increments.
A 30% deposit is required from any new client before any work is carried out. Any outstanding accounts for work carried out by Christine Storey are required to be paid in full, no later than 30 days from the date of the invoice unless by prior arrangement with Christine Storey.
Once a deposit is paid and work completed you are obliged to pay the balance of payment in full. Christine Storey is entitled to charge the Client for any fees incurred relating to commencement of collection and recovery processes for accounts that remain unpaid in excess of 30 days. Christine Storey reserves the right to delete web sites with accounts more than 90 days outstanding payment.
Christine Storey will not be liable for costs incurred, compensation or loss of earnings due to the failure to meet agreed deadlines.
Approving Proofs/ Designs/Websites
While all care is taken to avoid errors, Christine Storey will not accept responsibility for typographical errors, spelling mistakes or incorrect information on any project committed to print or production.
It is the responsibility of the Client to proof read and approve all final copy/content/layout before the production of artwork or the competition of websites.
No refunds or reprints are given after a Client-approved product/design has gone to print. It is the sole responsibility of the Client to notify Christine Storey of any such errors during the revision cycle and before the final files have been generated.
Please check document size requirements, bleeds etc and/or proofs thoroughly with your printer before accepting the final proof.
Once a website design is complete, Christine Storey will provide the Client with the opportunity to review the resulting work. Christine Storey will make minor changes at no extra cost. Minor changes include small textual changes and small adjustments to placement of items on the design, changes to images. It does not include changes to colour schemes, any navigation features or adding additional pages.
Whilst every endeavour will be made to ensure that the website and any scripts or programs are free of errors, Christine Storey cannot accept responsibility for any losses incurred due to malfunction, the website or any part of it.
The Client agrees to allow Christine Storey to add a small credit on the customer's website. This will be in the form of a small line of text placed towards the bottom of the page.
The Client also agrees to allow Christine Storey to place websites and other designs, along with a link to the Client's site on Christine Storey’s website for self-promotional purposes, unless agreed to by both parties in writing beforehand.
If the client does not supply their own domain name/hosting this will be purchased for them on behalf of Christine Storey. Domain/Hosting will remain the property of Christine Storey.
Australian business domains can be transferred to the client upon completion of the website.
It is agreed that websites (including but not limited to the design, programming files, database, content, images or any other files) developed for the client by Christine Storey may not be duplicated by the client, in whole or in part, unless specified otherwise in the original website development quote or agreed in writing. If any such website is duplicated without written consent, the client agrees to pay Christine Storey, at a minimum, the full fee, as agreed in the original website development quote, for each duplicate. Christine Storey reserves the right to seek further compensation for any such duplicate websites.
Christine Storey will help you to explore your key words/key phrases; however final key phrase choice is the responsibility of the Client. Christine Storey cannot guarantee any specific position in search engine results for your website. Only basic search engine optimisation is performed in accordance with current best practice.
Christine Storey cannot take responsibility if the Client’s site is "hacked". Christine Storey does not provide software updates or take responsibility if the software used becomes out of date and obsolete. Christine Storey does not take responsibility for any unforeseen advancements in technology that may have negative effects on any aspects of the Client’s site or system.
Ownership of copyright over all concepts and draft Artwork remains with Christine Storey. Upon full payment of account, copyright ownership will be transferred to the Client. Christine Storey retains rights to utilise Artwork and all design elements for portfolio/self-promotion.
It is the Client’s responsibility to ensure that any Artwork, images, files and text submitted do not violate Australian copyright laws. Christine Storey assumes all written and visual content adheres to copyright laws and all correct permissions have been sought and/or royalties paid for use.
The rights to photographs, videos, graphics and any third party items such as source code, always remain the property of their respective owners. Unless you have a specific written agreement in the quotation, all products, including Content Management Systems, interfaces, navigational devices, menus, menu structures, icons, templates, scripts, software, programming/source code, and all other components that comprise the Website, remain the property of Christine Storey including full ownership rights and all intellectual property rights.
In the event of the Client cancelling a project after a project has commenced, the deposit and all progress payments will be forfeited in lieu of compensation to Christine Storey. Ownership of all copyrights and the original products, including but not limited to artwork and websites, shall be returned to and retained by Christine Storey.
Additionally, if the project is more than 50% complete a pro-rata payment for time spent beyond the deposit and/or progress payments received is payable at the time of project cancellation.
The Client must also pay all fees incurred by Christine Storey in the course of the project, including but not limited to stock photography purchases, service payments such as web hosting.
Christine Storey shall not be liable for any failure or delay in supply or delivery of Artwork or services where such failure or delay is wholly or partly due to any cause or circumstances whatsoever outside the reasonable control of Christine Storey including but not limited to war, strikes, lockouts, industrial disputes or unrest, government restrictions or transport delays, fire, power outages, failure attributable to hosting suppliers, breakdown of plant, theft, vandalism, riots, civil commotions, accidents of any kind or act of terrorism.
Amendments to these Terms and Conditions
Any and all amendments to these standard terms and conditions must be provided in writing by the Client and signed by Christine Storey prior to the commencement of any and all work.
